The challenge
An appeal by public inquiry challenged Teignbridge District Council’s non-determination of a major 1,250-home scheme at Wolborough Barton, a sensitive site previously taken to the Supreme Court on HRA grounds.
Our solution
Our Lead Planning & Technical Ecologist, Chrissy Mason, acted as expert witness, preparing robust proofs of evidence in collaboration with the Council’s planning teams. This included a comprehensive review of Local Plan evolution, relevant case law, and Natural England’s objections. Chrissy coordinated further ecological assessment and designed proportionate mitigation to protect the South Hams SAC bat populations.
Outcome
Chrissy successfully defended the Council’s position under intense cross-examination, demonstrating that with additional safeguards, no harm would occur. Following Natural England’s withdrawal of objections, the Secretary of State granted consent. The permission was upheld through Judicial Review and a further appeal challenge.
